1. Newborn and Infant Screening and Treatment Code (77 Adm. Code 661)

The Universal Newborn Screening Advisory Committee (also known as the Genetic and Metabolic Diseases Advisory Committee) recommended to the Department that Guanidinoacetate methyltransferase (GAMT) deficiency be added to the Illinois newborn screening panel. GAMT deficiency is a rare inborn disorder of amino acid metabolism that results in a deficiency of creatine production that impairs the body’s ability to use and store energy. Individuals with GAMT deficiency typically appear normal and healthy at birth. However, their disorder affects brain and muscle function, causing seizures, developmental delay, impaired speech development, behavioral changes, low muscle tone, and movement disorders. Left untreated these debilitating symptoms may be irreversible and life-threatening. The rarity of the condition contributes to a high chance of significant delay in diagnosis and access to treatment. Detection through newborn screening preserves health and life by offering diagnosis and prompt treatment before symptoms occur.
Metachromatic Leukodystrophy (MLD) is being added to the Illinois newborn screening panel to address a rare inborn lysosomal storage disorder that causes progressive degeneration of the central and peripheral nervous system. People with MLD typically appear normal and healthy at birth. The disease onset is highly variable. People with the most sever clinical type, with onset before 30 months of life, will lose milestones and cognitive function with progressive deterioration often ending in death within about five years of disease onset. Detection through newborn screening protects health and life by offering the opportunity for diagnosis and treatment before the onset of symptoms.
This rulemaking request further increases the newborn screening fee to better align with IDPH Newborn Screening Program operational costs. Based on recent cost analysis and assessment of Department obligations, it is essential to maintain program operations and begin to address unmet needs.

2. Home Health, Home Services, and Home Nursing Agency Code (77 Ill. Adm. Code 245)

This rulemaking implements Public Act 103-0734, which added language to the Home Health, Home Services, and Home Nursing Agency Licensing Act to prohibit the Department of Public Health from charging a licensing fee to a certified local health department in connection with the licensure of a home health agency. This rulemaking also adds existing language from the Act clarifying the same prohibition for certified local health departments in connection with home nursing agencies, home nursing placement agencies, and home services placement agencies.

3&4. Hospital Licensing Requirements, 77 Ill. Adm. Code 250 [Combined for filing]

This rulemaking implements Public Act 103-0803, which amended the Hospital Licensing Act (the Act) adding and defining a new term "hospital affiliate" as subject to the patient rights requirements of Section 250.260(c). The rulemaking also implements Public Act 103-0948, which added a new Section to the Hospital Licensing Act regarding requirements that a hospital notify parents of a stillborn fetus of their right to receive a certificate of birth resulting in stillbirth ("Liam's Law notice") as described in Section 20.5 of the Vital Records Act. The rulemaking requires that a hospital utilize a notification form to be developed by the Department for parental education regarding "Liam's Law notice".

6. AIDS Drug Assistance Program (77 Ill. Adm. Code 692)

The purpose of this rulemaking is to update Appendix A with respect to the federal poverty level changing from the 2024 federal poverty level to the 2025 federal poverty level, as is required by the federal funder, the United States Health Resources and Services Administration. On January 17, 2025, the United States Department of Health and Human Services posted the new 2025 federal poverty level (FPL) in the Federal Register. 1. Mold Remediation Registration Code (77 Ill. Adm. Code 835)
The new Part, Mold Remediation Registration Code, will implement Public Act 103-893. This Act amended the Mold Remediation Registration Act by requiring the Department to adopt rules that establish procedures for persons who or entities that provide mold remediation services to register with the State, provide evidence of an active third-party certification, and provide evidence of financial responsibility. The new Part includes definitions, incorporated and referenced materials, and registration requirements.

2. Life Care Facilities Contract Code (77 Ill. Adm. Code 396)
This rulemaking seeks to implement Public Act 103-0812, which added requirements related to pre-sale disclosures and living unit reappropriations. The rulemaking also implements Public Act 103-119, which includes requirements for posting of information regarding the Long Term Care Ombudsman Program. In addition, the rulemaking implements Public Act 103-0332, which added requirements related to provisions of at-home continuing care. In addition to the statutory requirements from these Public Acts, the rulemaking makes other changes to align the Code with the Life Care Facilities Act and current Department procedures.

3. Community Health Worker Certification Program
This new Part will implement the Community Health Worker Certification and Reimbursement Act [410 ILCS 67]. The New Part will include but is not limited to establishing definitions. The New Part will also set out explanations, processes, and requirements regarding the community health worker (CHW) program application, certification and renewal; field experience supervision and standards of practice; training program application and approval; training program curricula and instructor requirements; and training program monitoring.

4. Manufacturing, Processing, Packing or Holding of Food Code (77 Ill. Adm. Code 730)
The rulemaking will include updates to the rules to implement current industry standards for the National Shellfish Sanitation Program and other manufactured food programs. The rulemaking will also seek to implement permit requirements and fees for regulated facilities. Additionally, the rulemaking will include cleanup and statutory and other updates. The Department intends to file a separate recodification for the amendment of the name of Subpart B to be changed to "Permits".

5. Intermediate Care For the Developmentally Disabled Facilities Code (77 Ill. Adm. Code 350)
This rulemaking implements Section 4-211 of the Mental Health and Developmental Disabilities Code, which requires facilities to provide access to sex education, related resources, and treatment planning that supports the residents right to sexual health and healthy sexual practices and to be free from sexual exploitation and abuse.

6. Intermediate Care For the Developmentally Disabled Facilities Code (77 Ill. Adm. Code 350)
Combined rulemaking: This rulemaking implements Public Act 103-0261, which created the Essential Support Person Act, and requires facilities to comply with the Essential support Person Act and Essential Support Person Code (77 Ill. Adm. Code 50). This rulemaking also adds a requirement for facilities to check the National Sex Offender Public Website to determine if individuals are listed on the national registry as a sex offender. The rulemaking also makes minor statutory updates to align the Code with Section 2-201.5 of the Act and other technical updates.

7. Home Health, Home Services, and Home Nursing Agency Code (77 Ill. Adm. Code 245)
These proposed amendments establish provisions for the delegation of skilled nursing activities, tasks, or interventions to other RNs, licensed practical nurses, and home health aides in specific situations. This is to align 77 Ill. Adm. Code 245 with provisions in the Nurse Practice Act [225 ILCS 65] and 68 Ill. Adm. Code 1300 regarding RN delegation.
