  1. Home Health, Home Services, and Home Nursing Agency Code (77 Ill. Adm. Code 245)

    These proposed amendments were intended to establish provisions for the delegation of skilled nursing activities, tasks, or interventions to other RNs, licensed practical nurses, and home health aides in specific situations. This was also intended to align 77 Ill. Adm. Code 245 with provisions in the Nurse Practice Act [225 ILCS 65] and 68 Ill. Adm. Code 1300 regarding RN delegation. Cleanup and technical amendments including definitions, referenced and incorporated materials, and other cleanup were adopted.

    The purpose of this rulemaking is to update Appendix A with respect to the federal poverty level changing from the 2025 federal poverty level to the 2026 federal poverty level, as is required by the federal funder, the United States Health Resources and Services Administration. On January 15, 2026, the United States Department of Health and Human Services published the 2026 federal poverty level (FPL) in the Federal Register.   2. Emergency Medical Services, Trauma Centers, Pediatric Emergency and Critical Care Centers, Stroke Centers Hospital Code, 77 Ill. Adm. Code 515

    The proposed amendments are intended to implement Public Act 103-0605 which will establish and reflect current national and state standards as well as new state laws that have been enacted regarding Thrombectomy Capable Stroke Center, Thrombectomy Ready Stroke Center and Primary Stroke Center Plus. In addition, these revisions will ensure consistency with current EMS System and EMS provider practices at the local level.
  3. Emergency Medical Services, Trauma Centers, Pediatric Emergency and Critical Care Centers, Stroke Centers Hospital Code, 77 Ill. Adm. Code 515

    Amendments include but are not limited to updating and adding language that includes the following updates to the current names of the organizations serving on the Illinois Emergency Medical Services Children (EMSC) Advisory Board merging two of the EMS protocols (the pediatric respiratory distress with a ventilator protocol), deletion of pediatric head trauma addendum requirement, updates to hospital disaster planning to ensure the presence of a surge plant that incorporates pediatric components, adding an integrated preparedness training and exercise plan as an option for multi-year training and exercise plan, language changes to clarify the facility recognition site survey visits and updates to the emergency department and pediatric inpatient supplies and equipment to assure consistency with current practice standards.
  4. Skilled Nursing and Intermediate Care Facilities Code (77 Ill. Adm. Code 300)

    This rulemaking implements Public Act 104-0191, which makes statutory updates to the Act related to the definition of "high-risk designation" and numerous requirements related to the transfer and discharge of residents, including new Sections 3-305.6 and 3-305.7 regarding requirements for readmission of a resident and penalties for noncompliance, and new Section 3-413.1 regarding requirements related to a denial of transfer or discharge. The rulemaking makes other technical and statutory changes to align the Code with the Act and current Department procedure.
  5. Skilled Nursing and Intermediate Care Facilities Code (77 Ill. Adm. Code 300)

    This rulemaking implements Public Act 103-1069, which amended the Nursing Home Care Act to prohibit retaliatory action by a facility, a licensee of a facility, or an employee of a facility against a resident who files a complaint against a facility or otherwise assists the Department in enforcement actions against a facility, as provided in P.A. 103-1069. P.A. 103-1069 also provides for residents to take civil action against a facility, a licensee of a facility, or an employee of a facility that engages in retaliatory action against the resident. Section 300.710 (Essential Support Persons) is being added to require compliance with the Essential Support Person Act (created by P.A. 103-0261) and rules.
  6. Sheltered Care Facilities Code (77 Ill. Adm. Code 330)

    This rulemaking implements Public Act 103-1069, which amended the Nursing Home Care Act to prohibit retaliatory action by a facility, a licensee of a facility, or an employee of a facility against a resident who files a complaint against a facility or otherwise assists the Department in enforcement actions against a facility, as provided in P.A. 103-1069. P.A. 103-1069 also provides for residents to take civil action against a facility, a licensee of a facility, or an employee of a facility that engages in retaliatory action against the resident. Section 330.797 (Essential Support Persons) is being added to require compliance with the Essential Support Person Act (created by P.A. 103-0261) and rules.
  7. Illinois Veterans' Homes Code (77 Ill. Adm. Code 340)

  8. Illinois Clinical Laboratories Code (77 Ill. Adm. Code 450) Filed 1-21-26

    This rulemaking implements Public Act 102-1051, which added the clarification that clinical laboratories shall examine specimens only at the request of a specified list of health care professionals, authorized law enforcement agencies, genetic counselors, and pharmacists. The rulemaking also provides clarification of existing requirements to align with federal regulations outlined in 42 CFR 493 as well as other technical clean up.
  9. Hospital Licensing Requirements (77 Ill. Adm. Code 250)

    This rulemaking, filed simultaneously with the emergency rulemaking, implements Public Act 104-0440, which added Section 6.14h to the Hospital Licensing Act. Section 6.14h requires general acute care hospitals and all other hospitals to adopt policies regarding interactions with law enforcement agents.
  10. Mold Remediation Registration Code (77 Ill. Adm. Code 835)

    The new Part, Mold Remediation Registration Code, will implement Public Act 103-893. This Act amended the Mold Remediation Registration Act by requiring the Department to adopt rules that establish procedures for persons who or entities that provide mold remediation services to register with the State, provide evidence of an active third-party certification, and provide evidence of financial responsibility. The new Part includes definitions, incorporated and referenced materials, and registration requirements.
  11. Life Care Facilities Contract Code (77 Ill. Adm. Code 396)

    This rulemaking seeks to implement Public Act 103-0812, which added requirements related to pre-sale disclosures and living unit reappropriations. The rulemaking also implements Public Act 103-119, which includes requirements for posting of information regarding the Long Term Care Ombudsman Program. In addition, the rulemaking implements Public Act 103-0332, which added requirements related to provisions of at-home continuing care. In addition to the statutory requirements from these Public Acts, the rulemaking makes other changes to align the Code with the Life Care Facilities Act and current Department procedures.
  12. Community Health Worker Certification Program

    This new Part will implement the Community Health Worker Certification and Reimbursement Act [410 ILCS 67]. The New Part will include but is not limited to establishing definitions. The New Part will also set out explanations, processes, and requirements regarding the community health worker (CHW) program application, certification and renewal; field experience supervision and standards of practice; training program application and approval; training program curricula and instructor requirements; and training program monitoring.

  1. Compassionate Use of Medical Cannabis Pilot Program, 77 Ill. Adm. Code 946

    Amendments to Section 946.10 will add additional qualifying conditions to the program, which have been approved by the Director of the Illinois Department of Public Health pursuant to Section 45(f) of the Compassionate Use of Medical Cannabis Program Act [410 ILCS 130]. The rulemaking adds endometriosis, ovarian cysts, uterine fibroids, and female orgasmic disorder as qualifying conditions approved by the Director. Amendments to Section 946.210 will add additional conditions under which a qualifying patient will qualify for reduced registration and renewal card fees. New qualifications will be for those participating in Women, Infants, and Children (WIC), Low Income Home Energy Assistance Program (LIHEAP), Supplemental Nutrition Assistance Program (SNAP), Temporary Assistance for Needy Families (TANF), or Medicaid. The amendments will also create reduced fees for those experiencing homelessness.
  2. Manufacturing, Processing, Packing or Holding of Food Code (77 Ill. Adm. Code 730)

    The rulemaking will include updates to the rules to implement current industry standards for the National Shellfish Sanitation Program and other manufactured food programs. The rulemaking will also seek to implement permit requirements and fees for regulated facilities. Additionally, the rulemaking will include cleanup and statutory and other updates. The Department intends to file a separate recodification for the amendment of the name of Subpart B to be changed to "Permits".

    This rulemaking, filed simultaneously with the proposed rulemaking, implements Public Act 104-0440, which added Section 6.14h to the Hospital Licensing Act. Section 6.14h requires general acute care hospitals and all other hospitals to adopt policies regarding interactions with law enforcement agents.
